1. Legal information

The website “theravia.com” (the “Site”) belongs to and is operated by THERAVIA SAS, with registered address 16 rue  Montrosier, 92200 Neuilly-sur-Seine, and Trade Register n° Paris 484 059 480 (hereinafter “Theravia”). The head of the publication is Franck Hamalian.

2. Theravia’s liability

2.1 Nature of the information of the Site

The purpose of the Site is to provide information related to the activities of Theravia, a company operating in the pharmaceutical field. The Site is dedicated to healthcare professionals, patients and general public. In general, the Site provides medical and commercial information about haematology, wound healing, anaphylaxis and surgery. The user acknowledges to be fully informed that the information contained on the Site is not intended, in any way whatsoever to:

  • give a medical opinion;

  • provide a diagnosis;

  • replace the consultation, advice or recommendations of a health professional;

  • promote or recommend the use of products, whether or not they are marketed by Theravia.

The user is informed that a doctor or other competent health professional must be consulted before any use of any product or before any use of any information on the Site.

2.2 Content of the Site

Theravia strives to the best of its ability to ensure that information published on the Site is accurate and up-to-date. It reserves the right to correct content at any time, without prior notice. However, Theravia cannot guarantee that the information available on the Site is accurate, correct, up-to-date or complete. Consequently, and except for property damage resulting from gross or intentional negligence by Theravia, the latter declines any liability:

  • for any inaccuracy, error or omission as regards information available on the Site;

  • for any damage resulting from fraudulent intrusion by a third party resulting in an alteration of information or items made available on the Site;

  • and more broadly, for any property damage or consequential loss, for any reason, of any origin, nature or with any consequences whatsoever, even if Theravia had been warned of the possibility of such damage or loss, caused (i) because of any access to the Site or because it was impossible to access it, (ii) because of the use of the Site, including any harm or virus that may infect your computer or any other property, and/or (iii) because of the credence given to any information coming directly or indirectly from the Site.

The components of the Site or of any other site are provided « as is » without any guarantee of any kind, whether implicit or explicit. Theravia does not offer any implicit or explicit guarantee, relative, without limitation, to their market value or suitability for any given purpose. The content of the Site is reviewed and validated beforehand by the qualified person of Theravia in accordance with the French laws.

2.3 Information about products

Information included and published on the Site may include direct or indirect references to products, programmes and services of Theravia that are not announced or available in some countries or some regions or that may be supplied under a different name and may be subject to regulations and terms of use that differ depending on the country. Such references do not mean that Theravia intends to sell those products, programmes or services in your country. Refer to Theravia or your Theravia’s sales partner for any information about the products, programmes and services available to you.

2.4 Update of the Site

Theravia makes its best efforts to provide up-to-date information on the Site. However, the proposed information may require an update that may not have occurred on the date of their consultation by the user. Theravia cannot be held responsible for any errors or omissions regarding the content of the information.

2.5 Availability of the Site

You acknowledge (i) that it is technically impossible to provide the Site free from any defect and that Theravia cannot undertake to do so; (ii) that defects may lead to the Site being temporarily unavailable; and that (iii) operation of the Site can be affected by events and/or matters that Theravia does not control, such, for example, as means of transmission and communication between you and Theravia and between Theravia and other networks.

Theravia and/or its suppliers may, at any time, alter or interrupt, temporarily or permanently, all or part of the Site to undertake maintenance and/or make improvements and/or changes to the Site. Theravia is not responsible for any alteration, suspension or interruption of the Site.

2.6 Virus

Internet is not a secure network. It is up to the users to take all appropriate measures to protect their equipment and the data stored on their equipment against everything.

Theravia disclaims any liability for damages not attributable to Theravia, and in particular in the event of loss, damage or destruction of files, transmission of viruses or viruses infecting its computer equipment or any other property at the connection and / or the consultation and / or use of the site.

2.7 Links to other sites

The liability of Theravia shall not be incurred by a third party site that can be accessed via the Site. Theravia does not have any way of controlling the content of such third party sites which remain entirely independent of Theravia. Moreover, the existence of a link between the Site and a third party site does not under any circumstances mean that Theravia approves the content of that site and in particular the use that may be made of it.

3. Intellectual property

The layout and each of the components, including – but not limited to – trademarks, logos and domain names, appearing on the Site, are protected by current laws on intellectual property, and belong to Theravia or its affiliated companies, or their use is the subject of authorisation from third party.

No component of the Site may be copied, reproduced, altered, edited, downloaded, denatured, transmitted or distributed in any way whatsoever, on any medium whatsoever, in whole or in part, without the prior written consent of Theravia, except solely for use for press requirements conditional on compliance with intellectual property rights and any other property rights that are mentioned. Copying for private use is only authorised for your own personal, private, non-commercial use, on your personal computer.

Where the consent to use the content of the Site has been granted by Theravia, the following statement should appear on any authorised copy of all or part of the content of the Site:

5. Legal provisions

The Site and its content are governed by the Laws of France, and any disputes relating thereto are subject to the jurisdiction of the courts of Paris.
